TERMS OF SERVICE

(Website, Digital Programs, and Coaching Services)

These Terms of Service (“Terms”) govern your access to and use of the website, programs, courses, and services operated by Trilateral Transformation, LLC (“Company,” “we,” “us,” or “our”).

By accessing this website or purchasing any program or service, you agree to be legally bound by these Terms in full.

1. Eligibility

You must be at least 18 years of age to use this website or purchase any services. By using this site, you represent and warrant that you meet this requirement.

2. Nature of Services (Coaching, Education Only)

All content, programs, courses, and coaching services are provided for educational and informational purposes only.

Health and wellness coaching is a non-medical, non-therapeutic, and non-clinical service intended to support personal development and lifestyle goals. The Company does not diagnose, treat, cure, or prevent any medical or psychological condition.

Nothing in these Terms or in any program or coaching session creates a physician–patient, therapist–client, dietitian–client, or other licensed professional relationship.

3. No Professional Healthcare Advice

You acknowledge that:

  • The Company is not acting as a physician, therapist, dietitian, or other licensed healthcare provider.

  • Any information provided is educational in nature.

  • You are solely responsible for consulting a qualified healthcare professional regarding any medical or mental health concerns before making changes to your health, fitness, nutrition, or lifestyle.

4. Programs, Courses & Time-Limited Access

When you purchase a digital program or course, you are granted a limited, non-exclusive, non-transferable license to access the content for four (4) months from the date access is granted, unless otherwise stated in writing.

Access automatically expires at the end of this period. Expiration of access does not entitle you to a refund, credit, or extension.

5. Coaching Services — Fees, Scheduling, and Cancellations

(a) Fees / All Sales Final

All coaching package sales are final and non-refundable. Once a coaching package is purchased, no refunds, credits, or prorations will be issued, regardless of whether you complete, use, or attend all sessions.

(b) Scheduling

Coaching sessions must be scheduled in advance through the Company’s designated booking method.

(c) Cancellations and Rescheduling

  • You may reschedule or cancel a session without penalty if notice is provided at least 24 hours before the scheduled session time.

  • If notice is provided with less than 24 hours’ notice, the session may be forfeited at the Company’s discretion.

(d) No-Shows

Failure to attend a scheduled session without prior notice (“no-show”) will result in forfeiture of that session, with no refund or credit provided.

6. Voluntary Participation and Assumption of Risk

You acknowledge that participation in coaching may involve lifestyle, behavioral, emotional, or wellness-related changes that carry inherent risks, including possible physical or emotional discomfort.

You voluntarily assume all known and unknown risks associated with participation in coaching services.

7. Personal Responsibility

You agree that you are solely responsible for:

  • Your own decisions, actions, and choices,

  • Any lifestyle, health, or wellness changes you implement, and

  • Seeking appropriate medical or professional care when needed.

The Company makes no guarantees of specific outcomes or results.

8. Confidentiality and Online Platforms

The Company will maintain your confidentiality to the extent reasonably possible and as required by law.

You acknowledge that coaching may occur via online platforms and that no electronic communication system is completely secure. You agree to participate notwithstanding these risks.

9. Intellectual Property

All content on this website and within programs, including text, videos, graphics, downloads, and course materials, is the exclusive intellectual property of Trilateral Transformation, LLC and is protected by copyright and other intellectual property laws.

You may not copy, reproduce, share, sell, distribute, or exploit any content without prior written consent.

10. Prohibited Use

You agree not to:

  • Share login credentials or course access,

  • Reproduce or distribute proprietary materials,

  • Use content for unlawful or unauthorized purposes, or

  • Interfere with website functionality or security.

11. Termination of Coaching Services (At-Will)

Either party may terminate coaching services at any time, with or without cause, upon written or electronic notice to the other party.

Grounds for termination by the Company may include, but are not limited to:

  • Failure to engage in or make reasonable effort toward coaching activities,

  • Repeated failure to attend or timely cancel sessions,

  • Harassment, abusive behavior, or unprofessional conduct, or

  • Conduct that the Company reasonably determines to be unethical, inappropriate, or inconsistent with a productive coaching relationship.

Upon termination, you are not entitled to a refund for sessions already rendered or for any unused sessions within a purchased package.

12. Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge Trilateral Transformation, LLC, its owners, employees, and contractors from any and all claims, liabilities, damages, or causes of action arising out of or related to your participation in coaching services or use of the website or programs.

This release applies to claims based on negligence, errors, or omissions, except where prohibited by law.

13. Disclaimer of Guarantees

The Company makes no guarantees regarding outcomes, results, or success. Testimonials or examples are not promises of results.

14. Limitation of Liability

To the fullest extent permitted by law, Trilateral Transformation, LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to use of this website, programs, courses, or coaching services.

15. Indemnification

You agree to indemnify and hold harmless the Company from any claims, losses, damages, or expenses arising from your use of the website or services or violation of these Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

17. Modifications

The Company reserves the right to update these Terms at any time. Continued use of the website or services constitutes acceptance of the revised Terms.
